Question
What is the
difference between a sexual predator and a sexual offender?
Answer
The basis for the classification of a sexual
predator or sexual offender is determined by the type of
crimes committed, but is ultimately decided by a judge.
Usually sexual predators have committed the more serious
crimes. Please obtain a copy of the "Public Safety Information
Act" brochure or review the Florida State Statutes (F.S.S.
775.21 and F.S.S. 943.0435) for more detailed definitions.
Question
Why can
some sexual predators live with 1,000 feet of a school or
daycare?
Answer
Sexual predators are prohibited from living within 1,000 feet
of a school or daycare as part of their probation conditions.
However, depending upon when their crime occurred and the age
of their victim, not all predators have this condition as part
of their probation. Some sexual offenders may also have this
condition as part of their probation. All conditions of
probation are decided by a judge and should be verified with
the Department of Corrections.(727-893-5510)
Question
How can I find out more about predators and offenders in
my area?
Answer
If you have the internet, go to
www.fdle.state.fl.us.
Click on "search our files for sexual predators/offenders"
then click on "search the data base." Once you have
gotten into the data base, you will be able to search by
different fields such as name, address, zip code, or county.
Please remember this will bring up all sexual offenders and
sexual predators associated with the field you chose to search
by. If you want to search sexual predators only, go to
advanced options and click in the box next to "Sexual
Predators only" then click "accept options."
This will take you back to "search the data base" to

Question
When can an officer arrest for "in view" violations of
probation?
Answer
Criminal offenders can be arrested for the
following four material violations:
- They will not use intoxicants to
excess or possess any illegal drugs or narcotics unless
prescribed by a physician. You will not visit places where
intoxicants, drugs or other dangerous substances are
unlawfully sold, dispensed or used.
- They will not possess, carry or own
any firearm.
- They will not associate with persons
engaged in criminal activities.
- They will live and remain at liberty
without violating any law. A conviction in a court of law
shall not be necessary in order for such a violation to
constitute a violation of probation/community control.
