Project Overview

Private-initiated application for map amendment to the City’s Official Zoning Map (from Neighborhood Suburban Single-Family-1 “NS-1” to Neighborhood Suburban Multi-Family-1 “NSM-1”) and Future Land Use Map (from Institutional “I” to Residential Urban “RU” approx. 0.21 acres; from Institutional “I” to Residential Medium “RM” approx.. 4.33 acres; and from Residential Urban “RU” to Residential Medium “RM” approx. 0.04 acres). The applicant is proposing to develop multi-family units.

On February 11, 2020, the CPPC conducted a public hearing for this request and voted 1-to-5 thereby recommending DENIAL. On February 21, 2020, Grace Connection of Tampa Bay Inc., Applicant, filed an appeal of the CPPC decision. On August 13, 2020, the City Council conducted a public hearing and voted unanimously to uphold the appeal, thereby overturning the CPPC’s recommendation and approving the requested map amendments to the City’s Official Zoning Map and Future Land Use Map. On October 5, 2020, the Planners’ Advisory Committee (“PAC”) voted unanimously to recommend approval of the Countywide Plan Map amendment to the Forward Pinellas Board.

On September 14, 2020, PGSP Neighbors United, Inc. filed a Petition for Administrative Hearing with the State of Florida Division of Administrative Hearings (“DOAH”) thereby challenging the Ordinance. In response, City staff requested the Forward Pinellas Board reschedule the public hearing until after resolution of the DOAH challenge. On November 17 and 18, 2020, City Staff and legal representation for the petitioners appeared in Tallahassee for a disputed-fact evidentiary hearing. On March 3, 2021, the Administrative Law Judge recommended that the Department of Economic Opportunity (“DEO”) enter a final order determining the subject ordinance to be in compliance, which DEO has since completed.
